Right to work’ quarterly penalty reports

If you haven’t cast an eye over at Gov.uk you may not have come across their ‘Illegal working penalties: quarterly totals’ report.

So you may not know that, if you’re found guilty of employing someone that doesn’t have the right to work in the UK, you could face:

  • A five year jail sentence
  • Unlimited fines (up to £20,000 per illegal worker found)

In the first quarter of 2019 alone, the gross value of penalties issued was getting towards £10 million**.

But you can avoid these penalties if you properly manage compliance. By following set processes, and being able to prove this, you have what is known as a ‘statutory excuse’. If you have a ‘statutory excuse’ you wouldn’t be liable for a civil penalty.*
